Terms of Service
The rules for using Posty: who is contracting with whom, how campaigns and payouts work, content rights, fees, fraud, and how an account ends.
Last updated
Working draft. This document is published so app stores and partners can read it, and is still going through legal review in each market Posty serves. We will post a new version, with a new date, when that review lands.
The Traditional Chinese (Taiwan) wording is the authoritative version of this document; this translation is provided for convenience.
These terms cover the Posty marketing site (posty.so), the Posty dashboard (app.posty.so), the Posty mobile apps, and the Posty mini-app inside LINE. By creating an account or using any of them, you accept them.
Who is contracting with whom
Posty is a marketplace with three kinds of participant:
- a brand (or an agency acting for its clients), which posts a brief, chooses creators, approves work and funds the campaign;
- a creator, who applies to a brief, makes the content, publishes it and is paid; and
- Posty, which runs the platform, holds the money in between, verifies the numbers, issues the paperwork and pays the creator.
Your agreement with Posty is these terms. Your agreement about a specific piece of work is the creator contract you sign inside the product when a collaboration starts. That contract — its wording, its rights grant, its governing law — is the binding document for that job. Where it and these terms disagree about the job, the contract wins.
Today only the Taiwanese, Traditional Chinese contract wording is in force. The versions for the other nine markets are drafts pending legal review, and a collaboration cannot rely on them.
Posty is not your employer
A creator on Posty is an independent contractor. Nothing here creates an employment relationship, a partnership, a joint venture or an agency between you and Posty, or between you and a brand, unless a signed contract says otherwise.
You are responsible for your own taxes and social insurance, wherever you live. For creators paid in Taiwan, Posty withholds tax and the health-insurance supplement where the law requires it and issues the corresponding labour-income and withholding statements (勞報單 / 扣繳憑單) — that is administration on your behalf, not employment.
Accounts
You must be at least 16 to create a creator account. Between 16 and 17 you must confirm you have a guardian's consent, and you may take gifted collaborations only — paid work and payouts are blocked until you turn 18. Brand and agency accounts are for people acting for a business.
Give us accurate information and keep it current. You are responsible for what happens under your account, including what people you invite to your brand or agency workspace do. Sign-in links and app session tokens are personal; do not share them.
Campaigns, hiring and approval
A brand publishes a brief with a budget, a deliverable and a payout rule. Creators apply. The brand picks. Work is submitted in the product, and the brand approves it or asks for a revision. Posty may hold a submission for its own review — including an automated pre-screen for missing advertising disclosure — before it reaches the brand.
You must disclose paid partnerships as the platform and your local advertising rules require. Posty may refuse, remove or unwind a collaboration whose content is undisclosed, illegal, or in breach of the platform it was published on.
Payouts
Payout rules are set per campaign and can combine a flat fee, a CPM ladder on verified views, a bonus for hitting a threshold in a window, a share of attributed sales, and a separate fee for paid-advertising rights. The rule is written into the brief before anyone applies.
- A campaign must be funded before creators are paid. Posty pays out against committed funds tied to a signed contract; there is no reloadable brand wallet and no payout from a promise.
- Posty verifies the numbers a payout depends on — that the post is live, and the views, reach and orders attributed to it — before releasing money.
- Payouts are released after a hold: seven days after a post is verified for the base amount, thirty days for performance bonuses, so that refunds and removed posts can be reflected.
- Payouts are paid in New Taiwan dollars unless your payout method is on a rail that settles in another currency, in which case the exchange rate used is recorded on the payment.
- We can only pay you once your tax and payout details are complete and, in Taiwan, verified.
The detail of the amount, the schedule and the conditions for a specific job lives in that job's creator contract.
Content and rights
You own the content you make. What the brand may do with it is the rights grant in the contract for that job, and it is one of four packages:
| Package | What the brand may do |
|---|---|
| Organic | Use the post as published on your own channel |
| Paid, 30 days | Also run it as paid advertising for 30 days |
| Paid, 90 days | Also run it as paid advertising for 90 days |
| Paid, perpetual | Also run it as paid advertising with no end date |
A rights grant can additionally authorise Instagram Partnership Ads or TikTok Spark Ads, which requires an authorisation code you generate on the platform. Every grant, its package, its expiry and its evidence are listed on your Rights page in the dashboard, and a grant that has expired or been revoked is shown there as such.
You grant Posty a limited licence to store, display and process your content inside the product so we can run the collaboration, show it to the brand, verify it and report on it. We may show a published post in Posty's own marketing only with your agreement.
You promise that the content is yours to give: that you have the rights to the music, footage, likeness and trademarks in it, and that publishing it does not break the law or the platform's rules.
Acceptable use
Do not use Posty to:
- buy, sell or fake engagement — bought followers, view bots, click farms, engagement pods;
- misrepresent who you are, your audience or your results, or connect an account you do not control;
- publish content that is illegal, hateful, sexual, defamatory or dangerous, or that infringes someone else's rights;
- run a campaign whose disclosure is deliberately hidden from the audience;
- scrape, resell or systematically extract data from the product, or work around its limits;
- interfere with the platform's security, or with other people's accounts.
Posty uses automated fraud checks on posts and on link clicks, and keeps an audit log of decisions made in the product. A suspicious post can be flagged, held or rejected, and the account behind it suspended.
Fraud, refunds and clawbacks
Posty's fee is a percentage of what a brand pays creators — 10% for brands, 5% for agencies, 20% when Posty runs the campaign for you. Creators never pay a platform fee. Card and bank processing costs are passed through at cost.
When a sale attributed to a creator is later refunded, the share of the payout that was earned on that sale is clawed back: it is deducted from a payout not yet released, or, if the money has already gone out, recorded as a negative adjustment netted off the creator's next payment. Every clawback is written to the ledger and the audit log, and appears on the creator's earnings page.
If we find that a payout was obtained through fraud, faked engagement or a post that was taken down, we can reverse it, withhold future payouts and recover what was paid.
Availability
Posty is provided as it is. We do not promise that it is uninterrupted or error-free, and we can change or withdraw features. Several integrations named in the product — social-account connection, LINE messaging, card payment, non-Taiwan payout rails — are not switched on yet, and figures produced by them before they are enabled are placeholders, not measurements. Our privacy policy lists the current state of each.
To the extent the law allows, Posty is not liable for indirect or consequential loss, for lost profits, or for the acts of a brand or a creator you choose to work with. Nothing here limits liability that cannot be limited by law.
Ending it
You can stop using Posty at any time, and you can ask us to delete your account — see Delete your account. Deletion does not erase the accounting, tax and contract records we are required to keep; the privacy policy explains which ones and for how long.
We can suspend or close an account that breaches these terms, that is being used fraudulently, or that we are required to close. Collaborations already under contract, and money already owed for work already delivered and verified, survive the closure.
Governing law
These terms are governed by the laws of Taiwan, and the Taipei District Court is the court of first instance for a dispute about them — subject to any mandatory consumer protection in the country you live in.
This choice, and the equivalent clause in the creator contract for each market outside Taiwan, is still going through legal review. Only the Taiwanese contract wording is in force today.
Changes
When these terms change we publish a new version and change the date at the top. If a change materially affects work already agreed, the contract signed for that work continues to govern it.
